This Texas Privacy Rights Addendum supplements the IHM Holdings Privacy Policy and applies to residents of Texas. It describes how International Healthcare Media, LLC ("IHM," "we," "us," or "our") collects, uses, discloses, and otherwise processes personal data of Texas residents, and the rights you have under the Texas Data Privacy and Security Act ("TDPSA," Tex. Bus. & Com. Code Ann. §§ 541.001–541.205), effective July 1, 2024.
This notice applies to you if you are a resident of Texas acting in an individual or household context. It does not apply to:
Important: Unlike many other state privacy laws, the TDPSA does not have a minimum revenue threshold or a minimum number of consumers processed. It applies broadly to any person that conducts business in Texas, or produces products or services consumed by Texas residents, that processes personal data and is not a small business. This makes it one of the most broadly applicable state privacy laws.
We collect the following categories of personal data from Texas residents:

We share personal data with service providers who process data on our behalf under written contracts that restrict their use of the data to the services we have engaged them to provide.
IHM shares personal data with advertisers, sponsors, and marketing partners — including identifiers, professional information, internet activity data, and inferences — for purposes of targeted advertising and direct marketing. Under the TDPSA, this constitutes the "sale" of personal data and/or processing personal data for "targeted advertising."
Categories of third parties receiving personal data:
Under the TDPSA, the "sale of personal data" means the sharing, disclosing, or transferring of personal data for monetary or other valuable consideration by the controller to a third party. IHM does share personal data for monetary consideration. You have the right to opt out of the sale of your personal data.
Under the TDPSA, "sensitive data" includes personal data revealing racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, citizenship or immigration status, genetic or biometric data, children's data, and precise geolocation data.
IHM does not intentionally collect most categories of sensitive data. As a healthcare media company, content engagement on our websites may indirectly reveal health-related interests, which may qualify as data concerning a "mental or physical health diagnosis." We will obtain your consent before processing sensitive data, as required by the TDPSA.
We do not collect precise geolocation data (GPS-level).
Small Business Exception for Sensitive Data: The TDPSA provides limited exceptions for small businesses (as defined by the SBA) regarding the sale of sensitive data. IHM complies with all sensitive data requirements regardless of this exception.
As a Texas resident, you have the following rights under the TDPSA:
You have the right to confirm whether we are processing your personal data and to access such data.
You have the right to correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of the processing.
You have the right to request deletion of personal data you have provided to us or that we have obtained about you.
You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format.
You have the right to opt out of the processing of your personal data for purposes of targeted advertising.
You have the right to opt out of the sale of your personal data to third parties.
You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
We will not discriminate against you for exercising any of your TDPSA rights.
Effective January 1, 2025, the TDPSA requires controllers to recognize universal opt-out mechanisms. IHM honors Global Privacy Control (GPC) signals and other recognized universal opt-out mechanisms. If your browser or device sends a GPC signal, we will treat that signal as a valid request to opt out of:

To protect your privacy, we will take reasonable steps to verify your identity before responding to your request. We may ask you to confirm your email address, name, or other identifying information we have on file.
You may designate an authorized agent to submit a request on your behalf. We may require the authorized agent to provide written proof of authorization signed by you, and we may verify the agent's identity directly.
If we decline to take action on your request, you have the right to appeal our decision. To appeal:
