This Utah Privacy Rights Addendum supplements the IHM Holdings Privacy Policy and applies to residents of Utah. It describes how International Healthcare Media, LLC ("IHM," "we," "us," or "our") collects, uses, discloses, and otherwise processes personal data of Utah residents, and the rights you have under the Utah Consumer Privacy Act ("UCPA," Utah Code Ann. §§ 13-61-101 through 13-61-404), effective December 31, 2023.
This notice applies to you if you are a resident of Utah acting in an individual or household context. It does not apply to:
Note: The UCPA is considered the most business-friendly of the state comprehensive privacy laws. Unlike several other states, the UCPA does not provide a right to correct personal data, does not require data protection assessments, and does not mandate recognition of universal opt-out mechanisms.
We collect the following categories of personal data from Utah residents:
We process personal data for the following purposes:
We share personal data with service providers who process data on our behalf under written contracts that restrict their use of the data to the services we have engaged them to provide.
IHM shares personal data with advertisers, sponsors, and marketing partners — including identifiers, professional information, internet activity data, and inferences — for purposes of targeted advertising and direct marketing. Under the UCPA, this constitutes the "sale" of personal data and/or processing personal data for "targeted advertising."
Categories of third parties receiving personal data:
Under the UCPA, the "sale of personal data" means the exchange of personal data for monetary consideration by a controller to a third party. IHM does exchange personal data with third parties for monetary consideration. You have the right to opt out of the sale of your personal data.
Under the UCPA, "sensitive data" includes personal data revealing racial or ethnic origin, religious beliefs, sexual orientation, citizenship or immigration status, medical history, mental or physical health condition, treatment, or diagnosis, genetic or biometric data, and precise geolocation data.
IHM does not intentionally collect most categories of sensitive data. As a healthcare media company, content engagement on our websites may indirectly reveal health-related interests. The UCPA requires that we provide notice and an opportunity to opt out before processing sensitive data. This addendum serves as that notice.
As a Utah resident, you have the following rights under the UCPA:
You have the right to confirm whether we are processing your personal data and to access such data.
You have the right to request deletion of personal data you have provided to us.
You have the right to obtain a copy of your personal data that you previously provided to us, in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller.
You have the right to opt out of the processing of your personal data for purposes of targeted advertising.
You have the right to opt out of the sale of your personal data to third parties.
We will not discriminate against you for exercising any of your UCPA rights.
Note: Unlike some other state privacy laws, the UCPA does not include a right to correct personal data or a right to opt out of profiling. However, we will make reasonable efforts to correct inaccurate data upon request.
You may submit a request to exercise your rights using any of the following methods:
To opt out of the sale of personal data or targeted advertising:
To protect your privacy, we will take reasonable steps to authenticate your identity before responding to your request. We use a two-step verification process: we will confirm receipt of your request and then send a separate communication asking you to confirm that you submitted the request.
We will respond to your request within 45 days of receipt. If we reasonably need more time, we will notify you and may extend the response period by an additional 45 days.
